Agreement to Terms

By accessing or using the services provided by Western Equipment Repair Contract Services (WERCS Inc.), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These Terms of Service apply to all visitors, users, and others who access or use our services.

1Description of Services

WERCS Inc. provides industrial paint booth service, repair, maintenance, and related equipment services. Our services include but are not limited to:

  • Paint booth repair and maintenance
  • Equipment installation
  • Preventive maintenance programs
  • Emergency service calls
  • Equipment inspections
  • Parts and filter replacement
  • System upgrades and retrofits
  • Compliance consultations

2Service Agreements

Specific services may be governed by separate service agreements, quotes, or work orders. In the event of any conflict between these Terms of Service and a specific service agreement, the terms of the specific service agreement shall prevail.

Important:

All service quotes are valid for 30 days from the date of issue unless otherwise specified. Pricing may be subject to change based on equipment condition upon inspection.

3User Responsibilities

When using our services or website, you agree to:

  • Provide accurate and complete information when requested
  • Ensure safe access to equipment for our technicians
  • Comply with all applicable laws and regulations
  • Not interfere with or disrupt our services
  • Maintain appropriate insurance for your equipment and facility
  • Promptly report any safety concerns or equipment issues

4Payment Terms

Payment Due

Net 30 days from invoice date unless otherwise agreed

Late Payments

May be subject to service charges and suspension of service

Deposits

May be required for large projects or new accounts

Emergency Services

May require payment at time of service

5Warranties & Limitation of Liability

WERCS Inc. warrants that all services will be performed in a professional and workmanlike manner. Parts and components may carry manufacturer warranties as specified at time of sale.

Limitation of Liability

To the maximum extent permitted by law, WERCS Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or production time, regardless of the cause of action.

6Cancellation Policy

  • Scheduled service appointments may be cancelled or rescheduled with 24-hour notice
  • Cancellations with less than 24-hour notice may be subject to a service call fee
  • Emergency service calls are non-cancellable once a technician is dispatched
  • Service agreements may be terminated per the terms specified in the agreement

7Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of WERCS Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Washington State.

9Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the new terms.
